Jennifer Kesse and Tiffany Sessions Missing Persons Act


Project Jason is pleased to announce the passage of the Jennifer Kesse and Tiffany Sessions Missing Persons Act in the state of Florida. It was passed yesterday, and now awaits the governor's signature. It is scheduled to go into effect on July 1, 2008.
Congratulations to Drew and Joyce Kesse, Jennifer's parents, and all who helped pass this bill, a part of Project Jason's Campaign for the Missing.

Other states passed by Campaign for the Missing volunteers include CT, IN, NJ, and OR.

Here are some highlights of the bill.

Basic Summary:


An act relating to missing persons; amending s. 937.021, F.S.; requiring law enforcement agencies to adopt written policies and procedures to be used when investigating missing person reports; requiring law enforcement agencies to submit information to specified databases; providing immunity from civil liability for certain persons involving such reports; requiring that a law enforcement agency obtain a DNA sample after a person has been missing more than 90 days; requiring the Department of Law Enforcement to adopt rules; amending s. 937.022, F.S.;renaming the Missing Children Information Clearinghouse the "Missing Children and Persons Information Clearinghouse"; requiring the clearinghouse to collect and process information regarding missing children, missing persons younger than 26 years of age, and missing persons suspected by a law enforcement agency of being in danger or a victim of criminal activity; providing definitions; providing an effective date.



Highlights:

LE (Law Enforcement) must have written procedures regarding the proper investigation of cases, use of available resources, and monthy review of cases.

Missing persons must be entered into the NCIC and the FL CIC databases within 2 hours.

When a person has been missing for 90 days, DNA may be obtained from the person's belongings or the appropriate biological family members. LE can obtain DNA before the 90 days if need be.

The state clearinghouse shall now also include information about missing persons through age 25, and any missing person LE considered to be engandered or a victim of criminal activity. LE is required to report information about these cases to the state clearinghouse.

FL LE shall establish a means to communicate case information about the case types as noted above.

LE is encouraged to transmit information about the above missing person case types to media and other interested parties who may be on the same distribution list as those on the Amber Alert list. Any person on this list who complies with the request cannot be held liable for any damages in complying with the request to disseminate this information.

(The last point and second point above are the ones which seems to confuse some media into thinking the bill extends the age of Amber Alerts and/or causes an alert to be issued in all cases. As you can see, it does not.)

We are planning a search for this Saturday at 9:30am.



Please meet us in the Annex Building when you arrive.

The Annex Building is a small building located right off of the main parking lot. (On the left as you drive into the main parking lot.) We will be searching in small groups throughout the entire 409 acres of property.

Officials confirm Crystal Hicks, who went missing in 2001, was pregnant at time of death

Dental records have determined that the human skull found by a hunter in Darlington County is that of missing person Crystal Hicks, according to Darlington County Chief Deputy Tom Gainey.
Gainey said the remains did test positively as those of Hicks, however, the remainder of the investigation will be primarily in the hands of Marlboro County officials, since Hicks was from that area.
“The only thing we’re releasing is that (the skull) was positively identified as Ms. Hicks, who has been missing nearly seven years,” Gainey said.
Hicks disappeared Aug. 9, 2001, from her mother’s home in Blenheim. Marlboro County Sheriff Fred Knight said it was confirmed that Hicks was pregnant the night she went missing.
“I talked with (Vivian Caulder, Hicks’ mother) just a little while ago, and she basically said before (Hicks) left home that night, she told her she was pregnant,” he said.
But Knight said he doesn’t know if that will have an effect on the investigation at this point.
He said Caulder did inform officers of the possible pregnancy at the time of her daughter’s disappearance in 2001. But based on the recent discovery, there are plans to renew the investigation into what happened that night.
“Marlboro County, Darlington County and (S.C. Law Enforcement Division) SLED are going to be joining together and make an attempt to see if there are any other remains,” Knight said. “We might find some evidence in the wooded area.”
He said the discovery of her remains could be a key to unlocking the mystery of what really happened to Crystal Hicks.
“Pretty much what has happened, she went missing back in August of 2001, and we never ever came close to finding anything out about her whereabouts,” he said.
Knight said he hopes that people who knew Hicks will come forward with information that might help uncover clues about her disappearance.
“We’re just looking for any information about what happened to Crystal Hicks,” he said. “Please let the public know that we are pleading for any information or help.”
At this time, only the identity of the skull has been released. Knight said he hopes more information is forthcoming.
Anyone with information about the disappearance of Crystal Hicks is asked to contact the Marlboro County Sheriff’s Office at (843) 537-6371. Knight said officers will make every attempt to protect the identity of callers.

The dad of missing Spanish girl Mari Luz Cortes said yesterday the possibility she has been snatched by Madeleine McCann's abductors is too awful to consider.
Tearful Juan Jose, 34, said: "It's possible that the disappearance of my daughter is linked to the Madeleine case.

"But it is not something we want to contemplate right now."

Mari, five, vanished on Sunday in Huelva - 120 miles from the Portuguese resort of Praia da Luz where four-year-old Madeleine disappeared on May 3.

Madeleine's dad Gerry said: "We are extremely concerned another young girl has gone missing in the region. We hope Mari is found quickly, safe and is returned to her family as soon as possible.

"Our thoughts are with her family as the search continues."

Dark-haired Mari vanished at around 5pm after asking her mother Irene for money to buy a bag of crisps at a kiosk 100 yards from their home. The Spanish frontier town of Huelva is just a 90-minute motorway drive from Praia da Luz. It is on the route Gerry and wife Kate fear that Madeleine's kidnappers may have taken as they smuggled her from Portugal into Spain - and then on to a boat to North Africa.

Investigators from Metodo 3, the Barcelona-based private detective agency working for the McCanns, were yesterday heading for Huelva as a huge police search for Mari continued into its third day. They will probe striking similarities between the two cases. Both girls are around the same age, both were left unsupervised by their parents and there are no definitive witnesses to either supposed abduction.

Spanish police are also said to be in contact with Portuguese authorities over the potential links.

Posters featuring photographs of Mari were yesterday being distributed along the Spanish-Portuguese border as 100 officers with sniffer dogs and 500 locals searched for her.

Mari wandered out of her home as mum Irene, 34, lay on the sofa feeling unwell.

She and husband Juan, a builder and former professional footballer, began to worry when she was not back after an hour and called police around 7.30pm on Sunday.

One potential witness claims to have seen a girl matching Mari's description on a bus in Huelva's suburbs with a woman of gipsy appearance who was shouting at her.

Juan last night begged for her return - in a plea that was a poignant reminder of the appeals that Kate and Gerry had made in Praia da Luz.

He said: "Whoever has her, bring her back and everything will be ok.

"If anyone has taken Mari Luz by mistake or if they thought she was lost, please bring her back." The McCanns' spokesman Clarence Mitchell said: "Gerry and Kate of all people know the agony that Mari's family are going through."

911 Call About Missing Woman Concerns Authorities

Roanoke Rapids — Halifax County authorities believe a missing woman is in danger after receiving a 911 call about her.

Shonda Stansbury's family reported her missing on Dec. 9. Investigators initially thought she left on her own, but a 911 call received five days later has authorities concerned.

A woman called Warren County 911 on Dec. 14 to report that she thought she saw Stansbury in trouble near the Information Grocery store off N.C. Highway 158 in Halifax County.

"A woman, a blonde-headed woman, and I believe it was Shonda Stansbury, was running from behind the Information," the caller said before her cell phone dropped the call.

The Warren County 911 center could only trace the call to a cell tower and never got the caller's name or phone number. A dispatcher passed the information to Halifax County.

Days later, Roanoke Rapids police spoke with the same woman, who said she saw two men chasing a woman she thought was Stansbury into a wooded area near the grocery store. She told police she waited until she got home to call 911 because she was afraid to stop.

Because of that call, investigators now consider Stansbury missing and in danger. But that lead is now more than two weeks old, and there is still no sign of Stansbury.

Stansbury was last seen wearing blue jeans, a gray blouse and white tennis shoes. Authorities said they hope someone will answer their call for help in finding her
